In property law, to take by purchase is to acquire title to land by one's own act or agreement (sale, gift, or devise) rather than by descent, that is, by inheritance through operation of law on an ancestor's death. Blackstone's Commentaries on the laws of England drew this line between title by purchase and title by descent, and Garner's Black's law dictionary preserves it, so a "purchaser" in this technical meaning includes anyone who takes otherwise than by inheritance, even a donee who paid nothing. The referent is a mode of acquiring property, defined against descent, and it is a different construct from leverage or from the everyday act of buying.[1][2]
